Criminal charges are divided into two general
categories. Misdemeanors are crimes
which are punishable by a fine and / or a maximum of one (1) year in jail. Felonies are crimes which are punishable by
more than one (1) year in prison. In addition to fines and imprisonment, a
person convicted of a crime may also be subject to a variety of other
punishments including community service, supervised probation, house arrest,
and participating in drug court. Just as
importantly, a criminal conviction, whether for a misdemeanor or felony, may
have a lasting negative impact on your
future.
MISDEMEANOR OFFENSES
DRIVING UNDER THE INFLUENCE (DUI)
A DUI conviction can impact the life of a defendant for years beyond the court date. DUI convictions can result in problems with employment, family, and financial situations that can prove difficult or impossible to completely resolve. If you have been charged with driving under the influence, allow our criminal defense lawyers to protect your rights and minimize potential penalties.
Other Misdemeanors
In addition to DUI, the attorneys of Garrett, Friday &
Garner are experienced in representing clients charged with other misdemeanor
offenses. Our attorneys represent
clients charged with misdemeanors in Justice Courts and Municipal Courts across North Mississippi. Other misdemeanor charges include:
- Drug Possession / Possession of Drug Paraphernalia
- Domestic Violence
- Minor in Possession
- Petty Larceny
- Public Drunk
- Simple Assault
- Speeding and other Motor Vehicle Violations
Persons convicted of a misdemeanor have the right to
appeal their conviction to either Circuit Court or County Court depending upon
the county in which the client was convicted.
Counties that have a County Court require the case first be appealed to
the County Court and then to Circuit Court if necessary. The attorneys of
Garrett, Friday & Garner have the experience necessary to assist you with
an appeal of a conviction from Justice Courts or Municipal Courts.
Expungements
Conviction for a crime, even a misdemeanor, can negatively
affect you throughout the course of your life. Many misdemeanors may be removed
from your criminal record via the process of expungement. An expungement can
prevent a previous criminal conviction from appearing on your record when you
have a background check completed for any reason, including a job application.
If you have been previously convicted of a misdemeanor, and in some cases a felony,
our attorneys can help you clear your record of the conviction.
FELONIES
A felony is the most serious criminal charge a person can
face. All felonies carry the possibility
of a lengthy prison sentence. When faced with a felony charge it is essential
that your attorney can, and will, spend the time and energy to fully
investigate the facts of the case and exercise all legal means to either have
the charge dismissed by way of a trial or assist you with negotiating the plea
agreement most advantageous to you. Felonies include:
- Aggravated Assault
- Burglary
- Felony Drug Charges
- Kidnapping
- Manslaughter
- Murder
- Robbery
- Sex Crimes
Our attorneys also represent clients who are dealing with probation revocation proceedings or need to appeal an improper conviction
before a circuit court to the Supreme Court of Mississippi. When you are facing a criminal charge you
must have the assistance of a good attorney and like any good attorney we will
only promise you that we will give you the best representation that we can and
that we will make ourselves available to you when you have questions or
concerns about your case.
